Tucson is the second most commonly misspelled city name in the U.S., right behind Pittsburgh. The word comes from the Pima Indian words "shook-son" meaning "at the foot of Black Mountain." The city was christened St. Augustine de Tucson by the Spanish in 1775.

Something every homebuyer should know

Back in the old days, say before 1985, all real-estate brokers and agents represented the Seller. When an agent showed you a property, she was doing so as the seller's agent. She owed the seller the duties of confidentiality, obedience, loyalty, disclosure, accounting, care and diligence, collectively known as fiduciary duties. A fiduciary is one who acts, in a legal role, in the best interests of another. You, as the buyer, were left to fend for yourself under the principle of Caveat Emptor , or Let the Buyer Beware.

Today, Arizona recognizes three kinds of agency:

  • Buyer Agency in which the Buyer Agent represents the best interests of the buyer and owes fiduciary duty only to the buyer.

  • Seller Agency in which the Listing Brokerage acts in the best interest of the seller and owes fiduciary duty only to the seller.

  • Limited Dual Agency in which the same brokerage represents both buyer and seller (sometimes through one agent, often through two different agents). Obviously, neither buyer nor seller can enjoy full fiduciary representation. However, both must be treated with honesty and fairness.

Working with an Exclusive Buyer Agent gives you the benefit of fiduciary representation, which means your agent must place your best interests ahead of all others including her own.
